Retention of title: until full payment has been made for the goods, the seller remains the owner of them, provided that they have not been processed or resupplied to third parties. As long as the goods have not been paid for, the buyer may not transfer ownership of them to third parties, except in the exercise of his normal profession or for the use of the normal purpose of the goods. In the event of non-compliance with this condition, the purchase price is immediately due and payable.

The buyer expressly and unconditionally acknowledges that the sale is governed by the internal law of the seller’s country, i.e. Belgian law. The buyer accepts Belgian law by means of an express clause. The buyer also expressly and unconditionally acknowledges that all disputes arising as a result of the purchase will be settled exclusively by the Belgian courts and more specifically the Justice of the Peace in Kortrijk.

Our invoices are payable in cash without a discount at our registered office, unless a payment term is expressly agreed. The acceptance of checks or bills of exchange does not change this.

In the event of punctual payment of our invoices, an interest of 1% per month will be due by operation of law and without notice of default. In addition, the invoice amount will be increased by 10% by operation of law and without notice of default, by way of a fixed and irrevocable clause, (with a minimum of Euro 62.-). Tacit waiver of interest or penalty clause cannot be presumed. No deduction by way of guarantee or other is permitted without our prior or written consent.

In order to be valid, any complaint must be submitted by registered letter within 8 days of receipt of the goods. If the good quality or quality of the delivered materials is disputed, any resulting liability on the part of the seller is limited to a maximum of the invoice value of the delivered goods, which is unconditionally accepted by the customer.

In the event that the buyer terminates the sales agreement, he will owe compensation of at least 30% of the total value of the order.
